必要があったので、改めて「子どもの権利条約」を通読しました。その備忘メモ。

・「子どもの権利条約」に「愛」という言葉は、前文に一箇所だけ。

Recognizing that the child, for the full and harmonious development of his or her personality, should grow up in a family environment, in an atmosphere of happiness, love and understanding,
（和訳）
児童が、その人格の完全なかつ調和のとれた発達のため、家庭環境の下で幸福、愛情及び理解のある雰囲気の中で成長すべきであることを認め、
・第20条の3「イスラム法のカファーラ」。イスラム教の養子縁組の仕組みらしい。初めて知った。

3. Such care could include, inter alia, foster placement, kafalah of Islamic law, adoption or if necessary placement in suitable institutions for the care of children. When considering solutions, due regard shall be paid to the desirability of continuity in a child's upbringing and to the child's ethnic, religious, cultural and linguistic background.
（和訳）
3 2の監護には、特に、里親委託、イスラム法の力ファーラ、養子縁組又は必要な場合には児童の監護のための適当な施設への収容を含むことができる。解決策の検討に当たっては、児童の養育において継続性が望ましいこと並びに児童の種族的、宗教的、文化的及び言語的な背景について、十分な考慮を払うものとする。
・この外務省訳は、「Parents」を「父母」と訳している。
・第42条～第45条は「国連・子どもの権利委員委員会」（Committee on the Rights of Children 略称CRC）についての取り決め。この条文が規程する仕組みが、世界および日本の子ども虐待防止に、間接的な効力を発揮している、と個人的には考えています。
第44条
1 締約国は、（a）当該締約国についてこの条約が効力を生ずる時から2年以内に､（b）その後は5年ごとに、この条約において認められる権利の実現のためにとった措置及びこれらの権利の享受についてもたらされた進歩に関する報告を国際連合事務総長を通じて委員会に提出することを約束する。
2 この条の規定により行われる報告には、この条約に基づく義務の履行の程度に影響を及ぼす要因及び障害が存在する場合には、これらの要因及び障害を記載する。当該報告には、また、委員会が当該国における条約の実施について包括的に理解するために十分な情報を含める。
・第54条 アラビア語、中国語、英語、フランス語、ロシア語及びスペイン語をひとしく正文とするこの条約の原本は、国際連合事務総長に寄託する。
Article 54
The original of the present Convention, of which the Arabic, Chinese, English, French, Russian and Spanish texts are equally authentic, shall be deposited with the Secretary-General of the United Nations. In witness thereof the undersigned plenipotentiaries, being duly authorized thereto by their respective Governments, have signed the present Convention.
